These Terms & Conditions govern your use of this website and the courses, resources and services provided by Lipstick Consulting Pty Ltd (ABN 15 619 120 482), trading as Nexus Association Management (“Nexus”, “we”, “us”). By accessing this site, downloading a resource, or enrolling in a course, you agree to these terms.

1. The agreement

This agreement is between you and Lipstick Consulting Pty Ltd (ABN 15 619 120 482), trading as Nexus Association Management. If you are entering into it on behalf of an organisation, you confirm you have authority to do so. If you do not agree with these terms, please do not use the site or our services.

2. Courses and resources

We offer self-paced online courses, downloadable resources, prospectuses and advisory services for association and not-for-profit leaders. Course content, pricing and inclusions are described on the relevant course page and may be updated from time to time. We aim to keep all descriptions accurate, but minor variations may occur.

3. Enrolment and access

When you enrol in a course, we grant you a personal, non-transferable licence to access the course content for your own professional development. Where a course is described as offering lifetime access, this means access for as long as we continue to operate the course platform. Login credentials are for your use only and must not be shared.

4. Payment

Prices are listed in Australian dollars (AUD) and, unless stated otherwise, are inclusive of GST where applicable. Payment is processed securely through our third-party payment provider. We do not store your full card details. Access to paid content is granted once payment is confirmed.

5. 30-day money-back guarantee

We stand behind our courses. If you are not satisfied, you may request a full refund within 30 days of purchase by emailing hello@thenexuscollective.au. This guarantee is offered in addition to — and does not limit — your rights under the Australian Consumer Law.

Refund requests made after 30 days are considered at our discretion. Where a course has been substantially completed or downloadable materials have been retained, we may decline a discretionary refund, except where required by law.

6. Intellectual property

All content on this site and within our courses — including text, frameworks, templates, workbooks, videos, graphics and the Nexus name and branding — is owned by or licensed to us and is protected by copyright. You may use the materials for your own professional use and within your own organisation. You may not resell, redistribute, publish or commercially exploit our materials, or present them as your own, without our written permission. Editable templates we provide are intended for your organisation’s internal use.

7. Acceptable use

You agree not to misuse the site or services, including by attempting to gain unauthorised access, sharing paid content, infringing our intellectual property, or using our materials in any unlawful way.

8. Disclaimer

Our courses, resources and advisory content are provided for general educational and informational purposes, drawing on Annie Gibbins’ experience as a multi-term association CEO. They do not constitute legal, financial, governance or professional advice for your specific circumstances. You should obtain your own professional advice before acting on any material. We do not guarantee any particular outcome.

9. Liability and your consumer rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under that law.

To the extent permitted by law, our liability for any failure to comply with a consumer guarantee (other than a guarantee that cannot be limited) is limited, at our option, to resupplying the relevant service or refunding the amount you paid. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss.

10. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

11. Changes

We may update these terms from time to time. The current version, with its “last updated” date, will always be available on this page.
